2017 Oakland Raiders User Agreement

By agreeing to purchase Oakland Raiders tickets or using this site, you agree to be bound by the terms of this Agreement.  Please note that Paragraph One contains a provision whereby your season ticket privileges are terminated in the event the Raiders elect to play home games in any stadium other than the stadium currently known as Oakland-Alameda County Coliseum (“Stadium”).  Please also note that Paragraph Eight of these terms contains a provision requiring binding arbitration of disputes between you and The Oakland Raiders (“Raiders”).  If you do not agree to these terms, please do not use this site or purchase Raiders tickets.   

1.         Stadium.  If Raiders elects to cease offering season tickets or playing home games at the Stadium, you agree that Raiders may terminate any and all season ticket privileges you have and deactivate any tickets issued to you.    In the event of such termination, you agree that your sole and exclusive remedy is a refund of amounts paid by you in advance for the 2017 season for games not played at the Stadium following such termination. 

2.         Other Policies.  In addition to agreeing to be bound by the terms and conditions of this Agreement, you further agree that you are subject to and bound by all National Football League (“NFL”) & Raiders fan and ticketing policies including but not limited to the Fan Code of Conduct, terms and conditions of any Ticketmaster related site, policies related to tickets set forth on www.raiders.com or otherwise communicated to you, policies of Stadium management, and the terms set forth on the back of or on each ticket provided to you.   

3.         Cost.  You agree that should you agree to purchase Raiders season tickets for the 2017 NFL season, you will pay the amount as invoiced to you by Raiders.  You agree that to the extent Raiders plays 2017 season post season games at the Stadium, that whether you may obtain tickets to such games and the cost of such tickets is subject to NFL and Raiders policies. You further agree that to the extent Raiders continues to play home games in the Stadium in 2017 but elects to play one or more home games in a stadium other than the Stadium (i.e. an International Series game), that whether you may obtain tickets to such games and the cost of such tickets is subject to NFL and Raiders policies.

4.         Your Contact Information.  You agree that the Raiders may contact you by phone, regular mail, and email regarding any actual or potential purchase of Raiders tickets.  You agree that if your name, mailing address, and/or email address change, it is your responsibility to provide updated contact information to Raiders and to ensure the Raiders properly confirms receipt of this information.  Any update of your contact information is not valid until acknowledged by Raiders.  Failure to ensure a proper update of your contact information means the Raiders may be unable to contact you regarding your account. 

5.         Payment.  You agree to provide a valid credit card number as a security deposit for any purchase, if requested.  You agree that Raiders may charge the credit card for amounts due for your tickets pursuant to any payment deadlines provided by Raiders.   

 

6.         Termination.  Should you fail to make any payments by the deadline set forth by Raiders, Raiders may terminate your season ticket and/or post season ticket privileges and deactivate any tickets issued to you.  In the event Raiders determines that you have provided false information related to your purchase, or you violate any of the Raiders or NFL policies, including but not limited to the Fan Code of Conduct, Raiders reserves the right to terminate your season ticket privileges. You understand that such termination shall include deactivation of any tickets provided to you.

7.         Privileges.  Should you purchase Raiders season tickets, you agree that you are purchasing season tickets for the 2017 Raiders season only for games played in the Stadium, and that you have no right or privilege to Raiders tickets in any future season or any other stadium where Raiders plays home games in any season.  Raiders reserves the right to, in its sole discretion, cancel, modify, or suspend the season ticket program and/or changes these terms at any time and for any reason without providing notice.  Raiders may at any time vary, revise, amend, withdraw, substitute, add or remove any of the terms and conditions of this agreement without notice to you.  

8.         Release and Indemnity.  You expressly agree to forever waive, release, discharge, and covenant not to sue the Oakland Raiders and/or any of its past and present partners, limited partners, owners, entity owners (and the current and former officers, directors, shareholders, partners, members, limited partners, assigns and employees of any owners or entity owners), employees, agents, attorneys, directors, officers, shareholders, contractors, successors, assigns and insurers (collectively “Raiders Related Parties”) of, for and from any and all claims, debts, liabilities, demands, obligations, costs, fees, expenses, actions and causes of action whatsoever, of every nature, character and description (collectively, “Claims”), known and unknown, including, but not limited to, all those arising out of or in any way related to any actual or potential purchase of season tickets; these terms; the termination of this Agreement; the legality of these terms; your use of the season ticket account manager portal and related sites, the negligence of Raiders or any Raiders Related Party; any actual or attempted sale of tickets, including but not limited to any tickets purchased by you; and any presence at any NFL stadium or on the field or sideline. You represent and warrants that you own and/or have the authority to release the Claims stated herein expressly waives Section 1542 of the California Civil Code, which provides:

“A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”

Further, you expressly agree to at all times defend, hold harmless, and indemnify the Raiders and all Raiders Related Parties from and against any and all Claims of any kind or nature whatsoever (including reasonable attorneys’ fees and disbursements) arising out of or in any way related to any actual or potential purchase of season tickets; these terms; the legality of these terms; the termination of this Agreement; your use of the season ticket account manager portal and related sites, the negligence of Raiders or any Raiders Related Party; any actual or attempted sale of tickets, including but not limited to any tickets purchased by you; and any presence at any NFL stadium or on the field or sideline.

9.         Binding Arbitration Agreement and Choice of Law.  These terms shall be construed and interpreted according to the laws of the state of California without regard to choice of law principles.  As a condition of participating in the deposit program, you and Raiders agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in any way connected with the deposit program or this Agreement, be resolved individually, without resort to any form of class action, exclusively through binding arbitration in San Francisco County before JAMS under its Comprehensive Arbitration Procedures (currently available at http://www.jamsadr.com/rules-comprehensive-arbitration/).  By entering into this Agreement, both you and Raiders waive any right to have any dispute arising out of or in any way connected with the program be resolved in a court of law by a judge or jury.  Arbitration shall be the exclusive remedy for any such dispute. You and Raiders agree to waive the right to commence, be a party to, or be an actual or putative class member of any class, collective, or representative action, except that you and Raiders may bring a representative action under any statute wherein their rights to bring such representative action are deemed unwaivable (such as the Private Attorneys General Act of 2004), but you and Raiders must bring such claims in arbitration.  If any portion or aspect  of this provision is found to be unenforceable for any reason, in whole, or in part, you and Raiders agree that the unenforceable portion or aspect of the agreement will be severed and the remainder of the provision, including the agreement to submit to binding arbitration, will remain valid and in effect. 

 

Further, to the extent permitted by law and subject to Paragraph One, under no circumstances will you be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than your actual out-of-pocket expenses, and you further waives all rights to have damages multiplied or increased.    

10.       Warranties.  You acknowledge and agree that the deposit program is being provided on an AS-IS basis and EXPRESSLY WAIVE ANY AND ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 

11.       Miscellaneous.  A waiver by Raiders of any breach or default of this Agreement shall not be nor be deemed to be a waiver of any other prior or subsequent breach or default of any provision of this Agreement.   The provisions of this Agreement are severable, and if any portion is determined invalid or unenforceable by a court of competent jurisdiction, the remaining portions will remain valid, enforceable and in effect to the fullest extent consistent with applicable law. 

Except as provided for in this Agreement, this Agreement constitutes the entire, integrated agreement of the Parties with respect to the subject matter of this Agreement.  Except as provided for in this Agreement, it is understood that there are no oral agreements between the Parties affecting this Agreement and that this Agreement supersedes and cancels any and all previous negotiations, agreements, and understandings, if any, between the Parties.  There are no other representations or warranties between the Parties and all reliance with respect to any representations is totally upon the representations contained in this Agreement.  Each Party’s obligations hereunder are in addition to, and not exclusive of, any and all of its other obligations and duties to the other Party, whether express, implied, in fact or in law.  

Renew & Win Sweepstakes Rules

2017 Renew & Win Sweepstakes Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN ANY PRIZE.  A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

  1. Deadlines:  To be eligible for any prize, you must submit a valid entry between January 5, 2017 and March 3, 2017 at 9:00 AM PST. 
  2. Prize: From among all those who submit a valid entry (each an “Entrant”), one (1) prize winner (“Winner”) will be selected at random to win the following:
    1. Two (2) tickets to one (1) Oakland Raiders (“Raiders”) away game during the 2017 NFL preseason or regular season.  Specific game and ticket location to be determined by Raiders.
    2. One (1) hotel room for two (2) consecutive nights in or around the city where the away game is taking place.  Hotel and dates to be determined by Raiders.
    3. Round trip coach airfare for two (2) between Oakland or San Francisco and the city where the game is taking place.  Airline, dates and seat assignments to be determined by Raiders.

ARV of prize is $1,500.  Any difference between stated value and actual value will not be awarded. 

Selection of Winners: A random drawing will be conducted by Raiders on or about April 30, 2017. The odds of winning depend on the number of eligible entries received. Raiders will make 3 attempts to notify a potential winner via telephone or email within 48 hours from the time the entry is selected. If the Raiders are unable to reach a potential winner via telephone or email within 48 hours after a potential winner is selected or if any message is not returned within 24 hours, then that potential winner will be disqualified and an alternate potential prize winner’s entry will be selected at random from the remaining eligible Entries.  All winners must execute an affidavit of eligibility before claiming any prize.  Raiders shall have no liability for any potential Prize winning notification that is lost, intercepted or not received by any potential prizewinner for any reason.

All selections shall be done via random drawing.  
 

  1. How to Enter: All Entrants agree that all decisions of the Oakland Raiders shall be final and Entrants waive any right to challenge any decisions made by the Oakland Raiders. Entrants expressly agree to be bound by the terms and conditions of these Official Rules and expressly agree to all of the terms and conditions herein. 

There are two ways to submit a valid entry. Only one entry is allowed per person or account.

  1. Season Ticket renewal.  Each Raiders Season Ticket Member and Club Seat Member that renews his or her season tickets for the 2017 NFL season by submitting payment in full on or before March 3, 2017 is automatically entered into one or more drawings in the 2017 Renew & Win Sweepstakes (the “Sweepstakes”).  One entry per account. 

Entrant may opt out of automatic entry by contacting Raiders.

  1. Mail a Postcard. To enter without purchase, send a postcard with your name, address, email address, telephone number, age, signature, and the phrase “I agree to the terms and conditions of the Official Rules of the 2017 Renew & Win Sweepstakes as posted on www.raiders.com and www.MyRaiderNation.com” via US Mail to the following address: The Oakland Raiders, Attn: 2017 Renew & Win Sweepstakes Entry, 1220 Harbor Bay Pkwy, Alameda, CA 94502.  One entry per person or account.  An entry via this method is valid only upon receipt by Raiders.  Raiders are not responsible for delayed, misdirected, or lost deliveries.
  1. Other Terms of Entry.  A purchase does not increase the odds of winning.  Each Entrant and/or Winner expressly consents to the use of his or her name, likeness, and biographical information for all publicity purposes by Raiders or any sponsor, without further compensation, except where prohibited by law. Winners will be solely responsible for any federal, state or local taxes on prizes. Prizes are non-transferable; no substitutions or cash redemptions. Raiders are not responsible for incorrect or inaccurate entry information whether caused by technical difficulty or human error. Odds of winning depend on number of eligible Entries received.

Winner and his/her guests must travel together on same itinerary and are responsible for obtaining all required travel documents, including but not limited to passports.  Winner and guest may be required to provide a credit card and/or identification at time of hotel/lodge check-in or at airport.  Raiders is not responsible for travel delays or cancellations. In the event Winner cannot obtain required travel documents or clearances, Winner will forfeit the prize and no substitute prize shall be awarded to Winner.  In the event the game is postponed and rescheduled, the trip will be rescheduled. In the event the game is postponed and not rescheduled, no compensation or substitution for such portion of the prize will be provided.

Winners and applicable guest must comply with rules and regulations of venue and Raiders. Failure to do so may result in forfeiture of such portion of the prize and removal from event. Raiders reserves the right to remove or to deny attendance to Winner and/or guest if such person engages in a non-sportsmanlike or disruptive manner, or behave in any way that is annoying, abusive, threatening or harassing any other person at the game. The tickets are subject to the terms and conditions specified thereon. If unused, tickets cannot be returned, refunded or exchanged for cash value or substitute tickets.  Any costs incurred due to changes to the original itinerary are solely Winner’s responsibility. Game date is subject to change.  Seating assignments to be determined by Raiders, in its sole discretion, at a later date. Travel and accommodations are at the Raiders discretion and subject to availability and change. Ground transportation, meals, gratuities, Passport fees, and all other expenses not specified herein are solely Winner’s responsibility.

  1. Eligibility and Liability: Sweepstakes is open to legal U.S. residents (except residents of Florida, New York, Rhode Island, and where otherwise prohibited) over the age of 21 who submit a valid entry account and agree to the terms in these Official Rules or who otherwise submit a valid entry. Employees, officers and directors of The Oakland Raiders, Raider Image, LLC, or their respective affiliates, officers, directors, or their immediate family members are ineligible. The Sweepstakes is subject to all federal, state, and local laws and regulations, and is void in Rhode Island, New York, Florida, and where prohibited. By entering the Sweepstakes or accepting any prize, all Entrants expressly agree to forever waive, release, discharge, and covenant not to sue the Oakland Raiders and/or any of its past and present partners, limited partners, owners, entity owners (and the current and former officers, directors, shareholders, partners, members, limited partners, assigns and employees of any owners or entity owners), employees, agents, attorneys, directors, officers, shareholders, contractors, successors, assigns and insurers or the Bose Corporation (collectively “Raiders Related Parties”) of, for and from any and all claims, debts, liabilities, demands, obligations, costs, fees, expenses, actions and causes of action whatsoever, of every nature, character and description (collectively, “Claims”), known and unknown, including, but not limited to, all those arising out of or in any way related to the Sweepstakes; these Official Rules; the legality of these Official Rules; Entrant’s entry; the negligence of Raiders or any Raiders Related Party; the acceptance, possession, misuse or use of any Prize; any travel related to any prize; any purchase of tickets; any participation in the Sweepstakes; and any presence at any stadium or on the field or sideline. Entrant represents and warrants that he or she owns and/or has the authority to release the Claims stated herein expressly waives Section 1542 of the California Civil Code, which provides:

Raiders is not responsible for errors or problems of any kind relating to or in connection with Sweepstakes, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, but not limited to, errors or problems which may occur in the administration of the Sweepstakes.  If for any reason an Entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible.

Further, by entering the Sweepstakes or accepting any prize, all Entrants expressly agree to at all times defend, hold harmless, and indemnify the Raiders and all Raiders Related Parties from and against any and all Claims of any kind or nature whatsoever (including reasonable attorneys’ fees and disbursements) arising out of or in any way related to the Sweepstakes; these Official Rules; the legality of these Official Rules; Entrant’s entry; the negligence, active or passive, of Raiders or any Raiders Related Party; the acceptance, possession, misuse or use of any prize; any travel associated with any prize; any purchase of tickets; any participation in the Sweepstakes; and any presence at any stadium, or on the field or sideline.

Raiders reserves the right to, in its sole discretion, cancel, modify, or suspend the Sweepstakes at any time. Raiders also reserves the right to substitute any similar prize or a prize of equal or greater value for any prize listed in these Official Rules or any other communication regarding the Sweepstakes and reserves the right to revoke the prize of any Entrant, at any time, if the Entrant acts in a manner that is, in the Raiders’ discretion, offensive, harassing, threatening, repugnant, or violent at any time.

The Sweepstakes is subject to all federal, state, and local laws and regulations, and is void where prohibited.

Code of Conduct

CODE OF CONDUCT:

Help us create the Most Fan-Friendly Environment in the NFL!

We want all fans to enjoy the action and excitement of Oakland Raiders football. We expect all who enter the Oakland Alameda County Coliseum and surrounding parking lots to adhere to this Code. Failure to follow this Code may result in ejection from the Oakland Alameda County Coliseum, revocation of ticket privileges, and/or arrest. Although Season Ticket Members may provide their tickets to others, the Season Ticket Member of record is responsible for the actions of those using their tickets.

The O.co Coliseum parking lot will close to the following activities immediately after kick off:

  • Consumption or preparation of food or beverages
  • Use of televisions, computers or other devices to view or project broadcasts or video of any kind

Those participating in these activities are subject to ejection from the stadium, parking lot, revocation of game tickets, citation and/or arrest for trespassing.

The following actions are violations of the Fan Code of Conduct:

  • Fighting, taunting, or any action that may harm, endanger, threaten, or bring discomfort to anyone.
  • Actions that impair others’ ability to enjoy the game, including mistreatment of other fans, verbal abuse, harassment, profanity, confrontation, intimidation, or threatening and irresponsible behavior.
  • Use of foul, abusive, or obscene language or gestures.
  • Any action that causes a disruption, creates an unsafe environment, or interferes with the game.
  • Sitting in a seat other than one’s ticketed seat; loitering in concourses, aisles, tunnels or stairs; or any unauthorized use of disabled seating areas.
  • Possession of any illegal drugs.
  • Intoxication or other signs of alcohol or substance abuse impairment that results in irresponsible behavior.
  • Smoking anywhere in the Coliseum, which is prohibited by the Oakland Municipal Code. This includes the use of electronic cigarettes and vaporizers.
  • Damage, destruction, vandalism, or theft of any property.
  • Refusal to remove or turn inside-out clothing deemed offensive or obscene upon request by stadium personnel.
  • Possession of any item listed on the Coliseum Prohibited Items List.

Failure to follow the directions of law enforcement, security, ushers, ticket takers, or any other stadium personnel, including refusal to submit to security screening, wanding, pat-down and search of your persons and belongings prior to entering the Coliseum.

Guests who are found in violation of the Code of Conduct may be required to take a four hour online Fan Conduct course in order to re-enter the O.co Coliseum for future games. Total cost of the online course is $250.

 

Permitted & Prohibited Items

BAG POLICY:

The NFL league-wide bag policy permits only the following bags in all NFL stadiums:

  • Bags that are clear plastic, vinyl or PVC and do not exceed 12"W x 12"H x 6"D.
  • One-gallon clear plastic freezer bag (Ziploc bag or similar).
  • Small clutch bag approximately the size of a hand, with out without a handle or strap.
    • This can be carried separately or within a plastic bag.

All other bags are prohibited when entering any NFL stadium.

 

PERMITTED ITEMS:

  • Bags that are clear plastic, vinyl or PVC and do not exceed 12”W x 12”H x 6”D.
  • One-gallon clear plastic freezer bag (Ziploc bag or similar).
  • Small clutch bags, 4.5”x6.5”x2”, with or without a handle or strap can be taken into the stadium with one of the clear plastic bag options.
  • Food in clear plastic wrap.
  • Small handheld TV’s and radios.         
  • Still cameras with lenses shorter than 6”.
  • Rain ponchos.
  • Insulin and diabetic supplies.
  • Breast pump and supplies.               

 

PROHIBITED ITEMS:

  • Bags larger than 12”W x 12”H x 6”D.
  • Bags smaller than 12”W x 12”H x 6”D that are not clear plastic, vinyl or PVC (These bags include:Backpacks.
  • Clear backpacks.
  • Tinted plastic bags.
  • Printed pattern plastic bags.
  • Fanny packs.             
  • Seat cushions.
  • Oversized tote bag.
  • Diaper bags.
  • Mesh bags.
  • Hard-sided containers of any size, including coolers and thermoses.
  • Glass bottles, aluminum cans, flasks, and camelbacks.
  • Containers carrying liquids of any kind.
  • Alcoholic beverages.
  • Illegal drugs.
  • Weapons of any kind.     
  • Projectiles, including frisbees, footballs and inflatable balls.
  • Any size pole or stick including selfie sticks or similar devices.
  • Umbrellas of any kind.
  • Artificial noisemakers of any kind.
  • Still cameras with lenses longer than 6” and camera cases.
  • Binocular cases.
  • Laser pointers, computers and large radios.
  • Portable chairs.
  • Seat cushions.
  • Scooters, bicycles, roller skates and skateboards.
  • Inappropriate attire or signage.
  • Non-service animals.
